Privacy Rights in Prince Edward Island

PEI's FOIPP covers provincial public bodies. Health privacy obligations are embedded in professional regulations and the Hospital Management Regulations.

TL;DR

PEI does not have a private-sector privacy law (PIPEDA applies) and does not have a standalone health privacy statute. The Freedom of Information and Protection of Privacy Act (FOIPP) covers provincial public bodies. The Information and Privacy Commissioner investigates complaints.

What applies in PEI

PEI's framework is the most limited of the provinces:

  • PIPEDA covers private-sector businesses.
  • FOIPP covers the provincial government and many agencies, boards, and commissions.
  • The Municipal Government Act contains access and privacy provisions for municipalities.
  • Health-information privacy is governed by a mix of FOIPP, the Hospital Management Regulations, and professional regulatory statutes.

The Commissioner's role

The PEI Information and Privacy Commissioner reviews complaints under FOIPP and the Municipal Government Act access provisions. The Commissioner has recommendation powers.
